Students often upgrade their engineering seats or switch to a different course after paying the initial admission fee. During the hectic counselling season, you might secure a seat in one college, only to get an offer from a better institution in a later round. When this happens, parents and students worry about losing the money they have already paid or struggling to get their school leaving certificates back.
Knowing the exact rules gives you the confidence to claim what is rightfully yours and move to your preferred college without financial loss.
What is the penalty for leaving an engineering seat after admission?
The penalty for cancelling your admission is strictly regulated by the University Grants Commission (UGC) and the All India Council for Technical Education (AICTE). These rules apply to all recognized higher education institutions, as detailed in a recent directive covered by NDTV. For the 2024-25 academic session, colleges were required to issue a 100% refund of all fees for cancellations made up to September 30, 2024. For withdrawals made up to October 31, 2024, the maximum penalty an institution could deduct was ₹1,000 as a processing fee.
If your admission schedule extends beyond these dates, or for future academic sessions where specific special dates are not announced, the standard 5-tier refund policy applies based on the formally notified last date of admission:
100% refund: Withdrawal notice submitted 15 days or more before the deadline.
90% refund: Withdrawal notice submitted less than 15 days before the deadline.
80% refund: Withdrawal notice submitted 15 days or less after the deadline.
50% refund: Withdrawal notice submitted 16 to 30 days after the deadline.
0% refund: Withdrawal notice submitted more than 30 days after the deadline.
In all cases, the caution money or security deposit must be refunded in full regardless of when you withdraw. This money is distinct from the tuition fee and cannot be forfeited.
Can a college keep my original certificates?
No, institutions are strictly prohibited from retaining your original School Leaving Certificate, mark sheets, migration certificates, or any other personal documents.
Colleges often ask to see original certificates to verify your identity and academic records during the initial admission process. However, according to the official guidelines, they cannot hold these documents as collateral to force you to stay or to demand tuition fees for subsequent semesters. Once they have verified your original documents, they must return them to you immediately. Refusing to return original documents is classified as a serious grievance, and you are well within your rights to demand them back when you submit your withdrawal application.
How to complain if a college refuses a fee refund?
If an institution violates these norms by delaying the refund beyond 15 days or refusing to return your documents, you do not have to accept their rejection.
First, approach the Grievance Redressal Committee (GRC) of the college itself in writing. Every recognized college is required to have an active GRC. If they do not resolve the issue, you can escalate the matter to the Ombudsman of the affiliating university. For nationwide complaints, students can register their issues directly on the UGC's centralized e-Samadhan platform. Institutions found guilty of withholding refunds face severe penalties, including the withdrawal of their approval to admit new students, withholding of central grants, or heavy fines. What to say to the administration (A script)
If you are withdrawing your admission and the college administration hesitates to process the refund or return your documents, keep the conversation polite but firm. Make your request in writing and use this script if you face resistance:
*"I am submitting my formal notice of withdrawal today, which is [X days] before the final admission deadline. Under the current UGC and AICTE fee refund guidelines, I am entitled to a [100% / 90% etc.] refund, minus the standard processing fee. The guidelines also strictly prohibit retaining original certificates, so I request you to return my mark sheets and process the refund to our bank account within the mandated 15 days. If we need to route this through the Grievance Redressal Committee, please let me know the procedure."*
Always ensure you get a dated, stamped acknowledgement on a copy of your withdrawal letter. This timestamp is the only proof of when you applied for the refund and determines the percentage you receive.
